3008 - Work Product Policy

For the purpose of this policy, the term “Work Product” shall mean any concept, tool, hardware, software, or other item, developed, written, created, or designed by the employee within the course and scope of, and during the term of, employment with Layton City.

This policy shall apply to all Work Product developed, written, created, or designed by employees, within the course and scope of and during the term of their employment with Layton City.

  1. Any Work Product produced by the employee within the course and scope of and during the term of employment with Layton City, shall be owned by Layton City.
  2. The City is entitled to, as a result of its ownership, continued use of the Work Product for the benefit of the City, for a perpetual period of time.
  3. The City supports, endorses, and encourages the employee to continue the development of Work Product as it benefits the City.
  4. Work Product may only be used outside the City for personal gain or benefit, with the express permission and at the sole discretion of the City Manager.
  5. Should the Work Product be used outside the City, the employee will maintain as confidential, any information considered by the City to be confidential.
