18.16.010. Approval procedure

            (1)        At any time after approval of the preliminary plat but not later than one (1) year thereafter, the subdivider may file the final subdivision plat for approval by the Planning Commission.  It shall be filed with seven (7) black and white copies.  After filing, the Community and Economic Development Department will submit the plat to the City Engineer, Fire Department, and Community and Economic Development Department for approval and checking by staff.  If staff finds that it meets the requirements of the City, the staff shall approve and return it to the Planning Commission.  Upon approval by the Planning Commission, the chairman shall sign the Planning Commission's certificate of approval and forward it for Council action.  Upon approval by the Council, the certificate of approval of the Council shall be signed and attested by the Mayor and City Recorder.  If the final plat is rejected by any of the foregoing officers or agencies of the City, it shall be returned to the subdivider with a written statement of the reasons for the rejection.

            (2)        A person may not submit a subdivision plat to the County Recorder's office for recording unless a recommendation has been received from the Planning Commission and:

                        (a)        the plat has been approved by:

                                    (i)         the City Council; or

                                    (ii)        other officers that the City Council designates; and

                        (b)        all approvals are entered in writing on the plat by the designated officers.

            (3)        A subdivision plat recorded without the signatures required under this Section is void.

            (4)        A transfer of land pursuant to a void plat is voidable.
