9.76.050. Seizure of obscene materials
(1) Any person who is authorized to arrest any person for a violation of this Chapter is also authorized to seize any of the prohibited articles found in possession or under the control of the person arrested.
(2) Upon the final conviction of the accused, the Prosecuting Attorney must cause any writing, paper, book, picture, print, design, figure, still or motion picture, photograph or negative thereof, photocopy, engraving, sound recording, card, instrument, or other form of media, which contains pornographic material, in respect whereof the accused stands convicted and which remains in the possession or under control of the Prosecuting Attorney, to be destroyed.
