1109 - Exhibit Items At Heritage Museum

Background

The Heritage Museum may display items or works of art owned by private individuals for exhibit or sale. The concern has been raised about the City's liability in the event such an item was lost or damaged.

Donated items become the property of the City when properly deeded. This section describes the process for receiving gifts to the museum.

Policy on Loss or Damage to Loaned Exhibits

Layton City does not insure against lost or damaged exhibits or art work loaned to the City. It shall be the responsibility of the owner to either be sufficiently self insured or to have the necessary commercial insurance to cover any and all potential losses.

Procedures for Receiving Loaned Items for Exhibit

(a) Owners of exhibit items, that are loaned to the City for display at the Heritage Museum shall be required to sign a Receipt for Loans at such time display items are received a the Museum. Care should be taken to insure that the owner is the one who signs this release.

(b) The Layton Arts Council, as a separate entity from the City, must also sign a Receipt for Loans when it loans items to the museum for exhibit.

(c) Loaned items shall be photgraphed by the Parks and Recreation Department.

(d) Completed Receipt for Loans forms and photographs shall be kept by the Parks and Recreation Director in a secure location other than the Heritage Museum.

Procedure for Receiving Gifts to the Heritage Museum

(a) The Deed of Gift form (attached) shall be used and properly completed when receiving gifts to the Layton Heritage Museum.

(b) Donated items shall be photographed by the Parks and Recreation Department.

(c) Completed Deed of Gift forms and photographs shall be kept by the Parks and Recreation Director in a secure location other than the heritage Museum.

Procedures for Receiving Items to be Displayed for Sale

(a) Owners of exhibit items, that are loaned to the City for display at the Heritage Museum shall be required to sign a Release and Waiver at such time display items are received at the Museum. Care should be taken to insure that the owner is the one who signs this release.

(b) The Layton Arts Council, as a separate entitiy from the City, must also sign a Release and Waiver of Liability when it loans items to the museum for sale.

(c) Loaned items shall be photographed by the Parks and Recreation Department.

(d) Completed Release and Waiver of Liability forms and photographs shall be kept by the Parks and Recreation Director in a secure location other than the Heritage Museum.
